Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Loopwell mobile application ("App," "Service"), operated by Serhiy Sukach, an individual based in Portugal, doing business as Loopwell ("Loopwell," "we," "us," "our"). By creating an account or using Loopwell, you agree to these Terms. If you don't agree, don't use the App.

These Terms are published in English only. The English version is the authoritative and legally binding text, regardless of the language you use elsewhere on this site.

1. Eligibility

You must be at least 18 years old to use Loopwell. By using the App, you confirm you meet this requirement.

2. Not Medical Advice

This is important, please read it carefully.

Loopwell is a self-tracking and organizational tool. It is not a medical device, does not diagnose any condition, does not recommend dosage or treatment changes, and does not replace your healthcare provider.

Any patterns, insights, or summaries generated by Loopwell (including AI-generated content) are based solely on the data you enter. They are observations about your own logged data, not medical guidance, and should never be used to make medication decisions without consulting a licensed healthcare provider.

Always talk to your doctor, pharmacist, or other qualified healthcare provider before starting, stopping, or changing any medication or dosage, and about any side effects or health concerns.

If you are experiencing a medical emergency, call your local emergency number immediately. Do not rely on this App in an emergency.

3. Your Account

You're responsible for keeping your login credentials secure and for all activity under your account
You must provide accurate information when creating your account
You can delete your account at any time from Settings → Delete Account

4. Subscriptions and Billing

Loopwell offers a free trial period (currently 14 days) that does not require payment information to start
After the trial, continued access to premium features requires a paid subscription, billed monthly or annually as selected
Subscriptions renew automatically unless cancelled before the renewal date, through your Apple App Store or Google Play account settings
Refunds are handled according to the policies of the App Store or Google Play through which you subscribed
We may change pricing with advance notice; changes apply to future billing cycles, not retroactively

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to access another user's account or data without authorization
Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law
Use automated systems (bots, scrapers) to access the App
Upload content that is harmful, abusive, or infringes on others' rights

6. Your Content

You retain ownership of the data and content you enter into Loopwell (logs, photos, notes)
You grant us a limited license to store, process, and display that content solely to provide the Service to you (including generating your AI insights and reports)
You're responsible for the accuracy of the information you log

7. Intellectual Property

The App, including its design, features, and underlying code, is owned by Serhiy Sukach (Loopwell) and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, logos, or branding beyond what's needed to use the App normally.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T GUARANTEE THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY INSIGHT GENERATED BY THE APP WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERHIY SUKACH (LOOPWELL) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Nothing in these Terms limits liability where prohibited by law (for example, liability for gross negligence or willful misconduct, where applicable).

10. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.

11. Changes to the App or Terms

We may update the App or these Terms from time to time. We'll notify you of material changes in-app or by email before they take effect.

12. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Lisbon, Portugal, unless applicable law requires otherwise.
